By using the Service, you represent and warrant that you meet all eligibility requirements.

To publish and sell books on Noogul, you must create a vendor account. When registering, you agree to:

• Provide accurate, current, and complete information
• Maintain the security of your password and account
• Promptly update your account information if it changes
• Accept responsibility for all activities under your account

You may not share your account credentials with others or use another person’s account without permission.

You are responsible for safeguarding your account credentials. You must immediately notify Noogul of any unauthorized use of your account. Noogul shall not be liable for any loss arising from unauthorized use of your account.

Noogul provides the following services to authors:

• Book Publishing: Upload, format, and publish ebooks and print books
• Distribution: Global distribution to 120+ countries through BookVault
• Print-on-Demand: No upfront printing costs; books printed only when sold
• Bookshop: A free eCommerce storefront for direct sales
• Analytics: Real-time sales data and royalty tracking
• Custom Services: Cover design, formatting, proofreading, and marketing

Noogul strives to maintain 99.9% uptime but does not guarantee uninterrupted access. We may temporarily suspend or modify the Service for maintenance, updates, or circumstances beyond our control. We will provide reasonable notice of planned downtime when possible.

You retain full ownership of all content you upload to Noogul, including:

• Book manuscripts and text
• Cover artwork and illustrations
• Book descriptions and metadata
• Author biographies and photos

By uploading content, you grant Noogul a non-exclusive license to reproduce, distribute, and display your content solely for the purpose of providing the Service (printing, distribution, marketing).

By uploading content, you represent and warrant that:

• You are the original creator or have necessary rights to the content
• Your content does not infringe on any third-party intellectual property rights
• Your content complies with all applicable laws and these Terms
• You have the authority to grant the license described above

The Service, including its design, code, logos, trademarks, and content (excluding User Content), is the property of Noogul Publishing and is protected by copyright, trademark, and other intellectual property laws.

You may not copy, modify, distribute, sell, or lease any part of our Service without written permission from Noogul.

Noogul respects copyright law. If you believe your copyrighted work has been used on the Service without authorization, please contact us at support@nooguls.com with:

• A description of the copyrighted work
• The URL where the infringing material appears
• Your contact information
• A statement of good faith belief

Noogul’s fee structure:

• Account creation: Free
• Book publishing: Free
• Platform fee: 35% of each sale (Dokan split: 65% vendor / 35% Noogul)
• Printing costs: Deducted per-unit from sale proceeds (varies by format)
• ISBN: $5.99 per ISBN (one-time, optional)
• Custom services: Varies by service (see pricing calculators)

Payments for custom services are processed through third-party payment providers (Paystack, Flutterwave, PayPal, cryptocurrency). Your use of these services is subject to their respective terms. Noogul does not store your payment card details.

Refunds are handled as follows:

• Custom services: Full refund if work has not started. 50% refund if work is in progress. No refund once work is delivered.
• ISBN fee: Non-refundable once assigned
• Print-on-Demand: Refund or reprint for quality issues reported within 30 days

You may not upload, publish, or distribute content that:

• Violates any applicable law or regulation
• Infringes on intellectual property rights of others
• Contains hate speech, discrimination, or promotes violence
• Is pornographic, obscene, or sexually explicit
• Contains defamatory, libelous, or slanderous material
• Is fraudulent, deceptive, or misleading
• Promotes terrorism, extremism, or illegal activities
• Contains malware, viruses, or harmful code
• Violates privacy rights of others
• Is AI-generated content presented as human-authored without disclosure

By You: You may terminate your account at any time by emailing support@nooguls.com. Termination takes effect within 24 hours.

By Noogul: We may suspend or terminate your account if:

• You violate these Terms or the Publisher Agreement
• You engage in fraudulent or illegal activity
• Your content violates applicable laws
• We are required to do so by law

Upon termination, your right to use the Service ceases immediately. Noogul shall not be liable for any termination of your account.

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND. Noogul disclaims all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Noogul does not warrant that:

• The Service will be uninterrupted, timely, secure, or error-free
• The results obtained from the Service will be accurate or reliable
• The quality of any content or services will meet your expectations
• Any errors in the Service will be corrected

TO THE MAXIMUM EXTENT PERMITTED BY LAW, Noogul shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of profits, data, or business opportunities
• Damages resulting from your use of the Service
• Damages resulting from any content uploaded to the Service
• Damages resulting from unauthorized access to your account

Our total liability shall not exceed the amount you paid to Noogul in the 12 months preceding the claim.

You agree to indemnify, defend, and hold harmless Noogul, its officers, directors, employees, and agents from any claims, losses, liabilities, damages, costs, or expenses (including reasonable attorneys’ fees) arising from:

• Your use of the Service
• Your content uploaded to the Service
• Your violation of these Terms
• Your violation of any third-party rights, including intellectual property rights

These Terms shall be governed by and construed in accordance with applicable international law. Any disputes arising under these Terms shall be resolved through:

• Mediation: If informal resolution fails, parties agree to mediation
• Arbitration: Binding arbitration as a last resort

Noogul reserves the right to modify these Terms at any time. Changes will be posted on this page with an updated “Last Updated” date. We will notify you of material changes via email or a prominent notice on the Service.

Your continued use of the Service after changes take effect constitutes acceptance of the modified Terms. If you do not agree to the modified Terms, you must stop using the Service.
